Federal Court Rulings Leave Future of Federal Vaccine Mandates in Doubt

Recent rulings from federal courts have put into question the future of two COVID-19 vaccine mandates instituted by the Biden Administration. On Nov. 29 and 30, two separate U.S. District Courts issued rulings halting implementation of the vaccination requirement for employees of healthcare entities receiving reimbursements from CMS; together, those rulings apply nationwide. The U.S. Fifth Circuit Court of Appeals on Nov. 12 granted a stay on the Occupational Safety and Health Administration’s Emergency Temporary Standard requiring employees of businesses with 100 or more employees to either be vaccinated or undergo regular testing. All of the rulings are expected to be appealed, and at this point the mandates’ future is uncertain.
