Pennsylvania Handbook: Informed Consent

MUST THE PATIENT SIGN A CONSENT FORM FOR EVERY PROCEDURE?

In Pennsylvania, the statutory “list” of procedures for which a signed consent form must be obtained may be found in The Medical Care Availability and Reduction of Error (MCARE) Act. From the MCARE Act these procedures include:

  • performing surgery, including the related administration of anesthesia;
  • administering radiation or chemotherapy;
  • administering a blood transfusion;
  • inserting a surgical device or appliance; and
  • administering an experimental medication, using an experimental device or using an approved medication or device in an experimental manner. See 40 P.S. 1303.504 (a).
